What’s the deal with these terms of use?

This the legal agreement between us when it comes to using our website and service. If you use qiip, you agree to these terms. Don’t agree with the terms? Don’t use qiip.

What’s qiip?

We’re a US company based in Florida with offices in Spain, Mexico and Colombia.

And what can I do with you?

Create work order requests and manage the whole maintenance process in an easy and simple way.

Can anyone use qiip?

You need to be at least 16 years old. If you’re between 14 and 16, you can use qiip if you’re with a parent or legal guardian.

What’s on your website?

Information about our product, services, and business. Our hard-working (and handsome) copywriters do their best to make sure all the info is accurate and up-to-date. Sometimes it’s not. If that’s the case, we won’t hold them responsible (you can’t hold them responsible either). But please do let us know and we’ll fix it.

Can I use qiip to run my illegal cockfighting ring?

No. Please don’t use qiip to break (or bend) the law. If any of our employees, partners, suppliers etc. have to pay money because you use the site illegally, you’ll have to pay them back.

Anything about indemnity in dem terms and conditions?

You agree to pay for any claim or demand (including attorneys’ fees) from any third party that comes as a result of:

  • You violating these terms when using our site and service
  • You breaking the law or suppressing the rights of someone else when using our site and service

I assume qiip works perfectly 100% of the time?

We try our best. But sometimes it might not work properly. We’re not liable for any technical errors, maintenance work, damage, wrongful use, unauthorized access, conflicts between you and other qiip users, and content you upload to qiip.

Who owns all the stuff on your website?

We do. It’s all protected by US and/or international regulations around intellectual property. That goes for our software, brands, labels, symbols, texts, graphs, drawings, videos, audio, sculptures, handwritten love letters, and toilet stall doodles as well. Please don’t change, copy, reproduce, or translate them unless we said you could.

What about other people’s stuff on your website?

We’re not liable for third-party content on our site (ad banners, for example) and we don’t endorse it. If you end up using anything provided by these third parties, it’s down to you to read and accept their policies.

Do you collect my data?

Yes, some of it. You can read more in our privacy policy and cookie policy.

Do you ever change your website or service?

Yep. We occasionally update, tweak, delete, experiment, or facelift aspects of our website or service. We’ll let you know if it’s going to affect you.

How are my rights protected?

Everything we do is governed by US law. You may also have rights as a consumer wherever you are in the world.

What’s the deal with these terms and conditions?

What’s qiip?

We’re a US company based in Florida with offices in Spain, Mexico and Colombia.

Can anyone use qiip?

You need to be at least 16 years old. If you’re between 14 and 16, you can use qiip if you’re with a parent or legal guardian.

How do I create an account?

You can create an account via our. Make sure the info you provide is accurate and up-to-date—and the account is for you and your maintenance team.

What sort of plans do you have?

The basic (free) plan lets you use all our basic features.

The PROS (paids) plan lets you collaborate with your team, and unlocks the most powerful features for brands.

Tell me about third parties

Sometimes we use other service providers (aka third parties). We’re not liable for anything they do. Third parties are also obligated to follow regulations.

You might decide to bring your own third party to the party, for example if you use webhooks or external providers. What they do is beyond our control and we’re not liable for any of it. Using them could mean data from your qiip account gets transferred elsewhere. Our advice? Read their own policies carefully so you understand exactly how they use your data and how they will provide their services.

What can I not do?

You can’t:

  • Share your account with anyone else. Please secure your login details. If you think someone else has your login details, contact us straight away at support@qiip.io It’s so you’re not then held responsible for anything shady that happens in your account.
  • Access qiip using anything other than our login page.
  • Mess with our security measures. Or those implemented by third parties.
  • Mess with areas of our site, product, or systems that aren’t open to the public.
  • Process any data considered ‘sensitive’ under data protection laws.
  • Use metatags or other hidden text on our website or service.
  • Trick people with fake elements on our website or service.
  • Use any element of our website or service—including our name, trademark, logo, layout and design—without written consent.
  • Mess with the content on our website by uploading new content, creating new links, etc. That includes the use of automated scripts, spiders, robots, crawlers, data mining tools, or anything similar.
  • Reverse engineer or tamper with our software.
  • Interfere with someone else’s access to qiip. Stuff like sending a virus, overloading, flooding, spamming, and mail-bombing. Not cool.
  • Reproduce, duplicate, copy, sell, trade, resell, or exploit for any commercial reason any part of the service (including your own qiip account).
  • Impersonate or misrepresent yourself.
  • Stalk or harass anyone else.
  • Share or use offensive or pornographic content.
  • Do stuff like vulnerability scanning, load testing, penetration tests, or bypassing our security measures.
  • Use services that monitor the availability, performance, and functionality of qiip for benchmarking or anything else.
  • Send spam, ads, email, junk, chain letters, or any other annoying things like that.

I saw someone else’s brand on your site. What’s up with that?

We sometimes use info, graphics, text, images, qiips etc. given to us by our users. You should only interact with them for the purposes of using qiip. Responsibility lies with the creator. Their reuse might be subject to terms and conditions. Best avoid republishing them without permission.

What do I need to keep up-to-date?

Your account information and your payment details.

What if I want to cancel or delete my account?

If you’re on the basic plan, the account will stay active until you delete it via the account settings.

If you’re on a PRO plan, they automatically renew monthly or annually (depending on how you decided to pay). You can cancel the renewal via the account settings. If you cancel, the subscription you already paid for will continue until the end of the month/year.

You can delete your account any time via the account settings. You might lose data if you decide to do this.

Can qiip delete my account?

We have the right to suspend or delete your account if you breach these terms and conditions. We’ll aim to give you 15 days notice, but we may delete it sooner if you break the law. You might lose data if your account gets deleted.

I’d like to know about warranties.

We do our best, but can’t guarantee that our service will work perfectly all the time. You agree to use the service at your own risk.

Is qiip liable for bad stuff happening?

To the maximum extent permitted by law, we’re not liable for any damages related to you using qiip. If we’re found liable under the law, it’s for a maximum amount of 12 months’ worth of fees.

How are my rights protected?

Everything we do is governed by US law.

The United Nations Convention on Contracts for the International Sale of Goods won’t apply.

If you live in a different country, US’s laws still apply. But the law in your own country could come into effect as well.

What do you charge money for?

We charge you to use some parts of our service—the PRO plan, to give one example.

Do you ever change your prices?

Yes, that might happen. We can change the price at any time—we have to give you notice first. For services we charge on a subscription basis, monthly users will get at least six months on the old pricing. If you pay annually, you’ll get at least one year on the old pricing from the point the new pricing comes into effect.

If you carry on using our service after changes come into effect, you automatically agree to the new price. What you then pay is not refundable, unless the law says it is.

If you don’t pay, we might suspend or delete your account—which means you could lose data.

Do prices include VAT?

Yes, plus any other applicable taxes.

Can I pay in gaming coins?

No. But you can pay with a credit or debit card.

We have no access to payment data, and we don’t store that information. Only the company processing payments has access to this—they’re certified as a PCI Service Provider Level 1.

Please make sure your payment information is up-to-date. If payment isn’t processed, we might suspend or delete your account.

How do you invoice?

We invoice every month or year—depending on how you decided to pay. We invoice in advance. We’ll send invoices to the email address you provided when you created your account.

Can I get a refund if I cancel my subscription or delete my account?

Sorry, no. If you cancel or delete before your subscription’s end date we can’t refund you or grant any credit.

qiip is a provider of a service, and not the owner of the collected data. However, as a service provider we do process all kinds of data and have lots of responsibilities too. Intrigued? Read on.

What personal data do I have to give qiip?

The only personal data required for using qiip are the basics you need when you and your users sign up. In other cases where you give out more info, it’ll be obvious what data you’re providing. For example, entering your email to sign up to a newsletter.

What do you do with all the data, and why do you do it?

  • Fulfilling our end of the deal, so you can use our service
  • Sending you emails, SMS, TXT, PUSH APPS or other comms
  • Using your browsing behavior on our sites (see cookie policy) for profiling purposes. This lets us send you better ads or personalized content.
  • Signing you in from third-parties (external maintenance providers etc.).
  • Complementing data we have from third parties (requires individual opt-ins), to send you better ads or personalized content.
  • Investigating things to prevent fraud, spam, phishing, and other no-no activities.
  • Dissociating you (the person) from you (the profile), to analyze user trends and get better at what we do.

Does anyone else have access to my data?

They wouldn’t have “access” to it, like seeing it in a list. But sometimes we use other services to complement our services to you. In those cases, the other provider may need to process your data. If so, they’ll have the same obligations as we do. You can oppose our collaboration with other service providers. However, qiip might choose to close your qiip account instead.

Here’s how we could use your data with other service providers:

  • Passing data through “browser cookies” so that other service providers can process it. This always needs your consent when it happens.
  • Sharing data with courts and authorities to take action against illegal activities, when that’s applicable. If you’re planning on doing that, I doubt you’d be reading this policy.
  • If you share qiip responses with third parties, you may have to inform the respondents, or comply with further legal requirements.

Where is my data/information processed?

Your information (not your respondents’ answers) might be processed in countries that don’t have the same data protection laws as those in your jurisdiction. You agree to this by agreeing to our privacy policy.

I’m moving to a cabin in Alaska and want all my data removed from everywhere. Can I?

Yes. You can wipe everything we have by withdrawing consent or deleting your account. You can also ask to see all the data we have, and object to some of the ways we use it. To do this, let us know:

Can I update my personal information?

Sure. Update your contact info in your account settings, or write us an email. If you want to unsubscribe to commercial or subscription emails, hit “unsubscribe” in the email (doesn’t apply to essential account-related emails).

Who processes my communications data into qiip?

We do on your behalf

Do I have control over what’s done with my personal or collected data? What happens if I’m up to no good?

We'll handle data according to your instructions. If we suspect these instructions break laws, we'll ask you to confirm the instruction. If you still want to do it, you'll be responsible for any and all legal and financial outcomes.

What about confidentiality?

Anyone at qiip who handles data does so with confidentiality.

What happens if qiip is hacked?

If we’re hacked or breached in a way that affects you, we’ll give you what you need to follow legal obligations. Just keep in mind that you’re responsible for filing reports under the law, and for notifying affected people. You’re also responsible for the costs or sanctions that come from inaction on your side.

If I deleted my account would you positively, absolutely delete all my data?

Yes, but the authorities could tell us to do otherwise. So unless you’re up to no good, don’t worry.

How do I know qiip sticks to their side of the deal?

We can give you what you need to feel confident about it. You also have the right to audit us once a year, but you’d have to pay for it (unless it turns out we’ve broken our agreement).

I am from European Union. Can I send collected data outside of European protection laws?

We have decided to comply with the requirements of GDPR. You can process or send collected data outside the European Economic Area—as long as the data transfer follows European regulations. If that’s not possible, you and qiip will default to the binding contract (no simplified version exists, sorry).

What if these terms change?

If we change anything, there’s a chance you’ll have to accept the changes before continuing to use our qiip. If you don’t agree to the changes, you’ll have 30 days to change your mind or stop using qiip.
